Brian Priestley is Counsel at Park Lawless & Tremonti. His experience includes representing Fortune 100 and other large companies in a wide range of complex litigation matters, including environmental contamination, pharmaceutical, medical device, and other products liability, data privacy, mass tort, consumer, and commercial cases. Brian has extensive experience in all aspects of litigation, ranging from preparing initial pleadings to representing clients at trial. He has extensive expertise in case management, conducting discovery, developing defense themes and strategies, drafting pre-trial and trial motions, and taking as well as defending depositions. Prior to joining the firm, Brian was an original member of the Los Angeles office of King & Spalding LLP, where he spent more than a decade.
Brian also has substantial experience handling pro bono matters on behalf of individuals in need of legal representation, including asylum seekers and incarcerated individuals. Notably, Brian prepared briefing in a matter involving claims of violation a prisoner’s Eighth and Fourteenth Amendment rights that culminated in a hearing before the Ninth Circuit.
Brian earned his J.D. from the UCLA School of Law in 2014 and his B.S. in Business Management from Menlo College in 2010, where he graduated magna cum laude. While in law school, Brian served as Chief Submissions Editor for the Entertainment Law Review.
Brian enjoys spending his free time with his wife, their two young daughters, and their Shih Tzu. Brian considers himself a cinephile, enjoys discovering new music, and bleeds Dodger and Everton blue.
Brian represents automotive manufacturers in Song-Beverly cases, including those where consumers allege fraud and unfair business competition under Business and Professions Code section 17200. He handles all aspects of these cases.
Brian was a member of a nationwide team that defended Monsanto Company against environmental contamination claims brought by various State Attorneys General and other local municipalities. The allegations centered on Monsanto’s historic production of polychlorinated biphenyls (PCBs), with the governmental entities claiming the chemicals caused statewide contamination of waterways and natural resources.
Brian represented AstraZeneca Pharmaceuticals LP in coordinated California state court product liability cases related to treatment with Crestor®, and Bristol-Myers Squibb Company and AstraZeneca Pharmaceuticals LP in litigation in state and federal courts related to treatment with Onglyza®, a type 2 diabetes therapy.
Brian represented Advanced Bionics LLC in a medical device case involving products liability and fraud-based claims concerning the company’s cochlear implants.
Brian represented Equifax in hundreds of cases in state and federal courts nationwide, including consolidated actions in Orange and San Diego counties, involving allegations related to the 2017 data breach and violations of the Fair Credit Reporting Act. Brian managed all aspects of these cases, including filing dispositive motions and participating in successful mediations and settlements.
Brian was a member of a team that conducted an internal investigation for Porsche AG and Porsche Cars North America and defended the sports car manufacturer against allegations that it knowingly installed undisclosed auxiliary emission control devices in certain their vehicles. Brian was involved in many aspects of this internal investigation, including conducting interviews of key employees, assisting the team analyze and prepare responses to requests or information from various entities—including the U.S. Environmental Protection Agency, California Air Resources Board, New York and other Attorneys General, and consumer action plaintiffs—and worked closely with senior team members to prepare a defense.
Brian represented a major wireless provider in a qui tam action brought under the California False Claims Act involving numerous State municipalities and universities, during which he deposed dozens of local officials and PMKs.
Brian has extensive experience in mass tort cases in the State of California and throughout the country. His experience in this area includes representing UOP LLC in claims alleging professional negligence related to its designs and specifications prepared for refineries around the world, representing Chevron and Texaco in cases alleging joint venture/alter ego liability related to the Abadan Refinery in Iran, and defending American Cyanamid Company in matters involving personal injury claims as a result of alleged exposure to asbestos from aerospace adhesives.
